Customer Service Agreement

This Customer Service Agreement ("Agreement") is between Get Pingy Pty Ltd trading as Get Pingy (ABN 31 700 271 629, ACN 700 271 629) ("Get Pingy", "we", "us") and the customer identified during signup ("you"). By starting a paid subscription or free trial you agree to this Agreement.

1. The service

Get Pingy is a missed-call SMS automation service. When a caller reaches your configured business number and does not connect, Get Pingy automatically sends a follow-up SMS on your behalf. The service uses a dedicated or virtual business number arranged through our telecommunications provider. Features and limits depend on your plan.

2. Onboarding and configuration

We will assist you with initial configuration (number provisioning, forwarding rules, message templates and business hours). Onboarding assumes you provide accurate business details and cooperate with reasonable requests.

3. Your responsibilities

  • Provide accurate business details and keep them up to date.
  • Ensure you have authority to use any numbers, messages and customer data you supply.
  • Ensure message content complies with the SMS & Electronic Communications Policy and the Acceptable Use Policy.
  • Keep account credentials secure.
  • Comply with all Australian laws applicable to your use, including the Spam Act 2003 (Cth), Privacy Act 1988 (Cth) and Telecommunications Act 1997 (Cth).

4. Service dependencies and interruptions

Get Pingy relies on third-party providers (Twilio for telephone/SMS carriage; Stripe for payments; Supabase / hosting; email and workflow automation providers — see the Third-Party Providers page). We aim for high availability but do not guarantee uninterrupted service, delivery of every call, SMS, email or lead, or specific carrier routing outcomes. Number availability, porting and number replacement depend on carrier processes and cannot always be guaranteed.

5. Fees and GST

  • Prices are quoted in AUD and are GST inclusive, unless clearly stated otherwise. Displayed prices match Stripe.
  • One-time setup fee — charged once at activation to cover onboarding and configuration. Non-refundable once configuration work has commenced (see the Refund and Cancellation Policy).
  • Monthly subscription fee — billed monthly in advance on the anniversary of your first paid charge.
  • Included SMS allowance — the number of outbound SMS messages included in your plan each billing period. See the pricing page for current allowances.
  • Excess usage charges — outbound SMS sent above the included allowance are billed at the per-SMS rate displayed on the pricing page.
  • Third-party or carrier charges — additional charges may apply where a carrier surcharge, international routing or premium destination is used.

6. Free trial

  • A 7-day free trial is available to new customers.
  • A valid payment method is required to start the trial.
  • The trial includes a limited outbound SMS allowance, disclosed at signup.
  • If you do not cancel before the end of the 7 days, your subscription automatically continues and your card is charged the setup fee plus your first month's subscription fee at the plan price displayed at signup.
  • You may cancel at any time before the end of the trial from your account or by emailing us; cancellation stops the automatic conversion to paid.

7. Automatic renewal, cancellation and suspension

Paid subscriptions renew monthly until cancelled. You may cancel at any time from your account or by emailing us; cancellation takes effect at the end of the then-current paid billing period. After cancellation, your subscription is retained in read-only mode until deletion in accordance with our retention practices. We may suspend or terminate your account for material breach, illegal use, or non-payment after reasonable notice where practicable.

8. Failed payments

If a scheduled payment fails, we may retry, notify you, and temporarily suspend outbound sending until payment is completed. Account access to your data is preserved during suspension.

9. Refunds

See the Refund and Cancellation Policy. Nothing in this Agreement excludes your rights under the Australian Consumer Law.

10. Data handling and privacy

Our handling of personal information is described in the Privacy Policy. You are the party responsible for the lawfulness of the customer data you provide and the messages you send through the service.

11. Intellectual property

All right, title and interest in the Get Pingy software, brand, trade marks and documentation remain with Get Pingy Pty Ltd. You receive a limited, non-exclusive, non-transferable licence to use the service during your subscription. You retain ownership of your own business data.

12. Confidentiality

Each party will keep confidential information of the other confidential and use it only to perform this Agreement, except where disclosure is required by law.

13. Liability

To the maximum extent permitted by law our aggregate liability for any claim connected with the service is limited to the fees you paid to us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, punitive or consequential loss, or loss of profits, revenue, goodwill or data. Nothing in this clause limits liability that cannot lawfully be limited (including under the Australian Consumer Law).

14. Indemnity

You will indemnify us against loss reasonably suffered by us as a direct result of your breach of this Agreement, your misuse of the service, or your breach of law, to the extent the loss is caused by your act or omission. This indemnity does not extend to loss caused or contributed to by us.

15. Dispute resolution

Before commencing court proceedings, the parties will attempt in good faith to resolve any dispute by written notice and, if not resolved within 21 days, by a meeting (which may be by phone or video).

16. Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this Agreement excludes, restricts or modifies those guarantees.

17. Governing law

This Agreement is governed by the laws of Queensland, Australia.
