These Terms govern your use of Get Pingy ("the Service"). By creating an account you agree to these Terms.

1. The Service

Get Pingy is an automation platform that automatically sends SMS replies to callers when you miss a call. Features and limits depend on your plan.

1a. Use of automation, AI and third-party services

Get Pingy provides automation tools that may integrate with or be used alongside third-party services, artificial intelligence systems or automated communication workflows. By using the Service you acknowledge and agree that:

  • We may use third-party providers for SMS delivery, carrier routing, hosting and AI-driven features such as message generation.
  • AI-generated content and automated workflows are provided for convenience only. You are responsible for reviewing and approving any AI-generated content before it is sent to your contacts.
  • We do not make any representations or warranties about the accuracy, completeness or suitability of AI-generated content for any particular purpose.
  • Third-party services are subject to their own terms and availability. We are not liable for issues arising from those third-party services except to the extent caused by our own negligence.
  • You must comply with the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth), the Telecommunications Act 1997 (Cth) and all applicable Australian laws.
  • You are solely responsible for complying with SMS marketing and consent laws, including obtaining express or inferred consent before sending messages.
  • You must only send messages to recipients from whom you have express or inferred consent.
  • Every automated message must include a working opt-out (e.g. reply STOP). You must honour opt-outs promptly.
  • You must not send misleading, deceptive, illegal, harassing or marketing content prohibited by law.

3. Fees and trials

Subscription fees are billed monthly in advance. The 14-day free trial requires no credit card. You may cancel at any time before the next billing cycle; cancellations take effect at the end of the current billing period. The optional one-time setup fee covers onboarding and configuration work (number provisioning, forwarding rules and initial AI reply setup).

4. Refund and cancellation policy

If you are not satisfied with the Service, you may request a full refund within 14 days of your first paid subscription charge. Refund requests must be sent to hello@getpingy.com.au with your account email. Approved refunds are processed within 5–10 business days to the original payment method. No refunds are provided for partial months or after the 14-day window, except where required by the Australian Consumer Law. The one-time setup fee is non-refundable once configuration work has commenced.

5. Opt-out and SMS handling

The Service automatically processes inbound "STOP" replies and adds the sender to a do-not-message list. You must not attempt to circumvent opt-out mechanisms.

6. Australian Consumer Law

Nothing in these Terms excludes any consumer guarantee or right under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

7. Liability

To the maximum extent permitted by law, our liability for any claim is limited to the fees you paid for the Service in the 3 months preceding the claim. We are not liable for indirect or consequential loss. As an automation platform, Get Pingy relies on third-party carriers and providers to deliver SMS messages. We do not guarantee 100% uptime or message delivery, and we are not liable for delays, failures or non-delivery caused by third-party networks, carriers or other factors outside our reasonable control.

8. Termination

We may suspend or terminate your account for breach of these Terms, illegal use, or non-payment.

8a. Intellectual property and brand protection

The "Get Pingy" name, logo, trade marks, domain names, website content, software, source code, designs, copy and all related materials are owned by Get Pingy and are protected by Australian and international intellectual property laws. All rights are reserved.

  • You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose during your subscription only.
  • You must not copy, clone, reproduce, reverse engineer, decompile, scrape, resell, sublicense, or create derivative works of the Service or any part of it.
  • You must not use the "Get Pingy" name, logo or any confusingly similar mark, domain or handle in a way that suggests endorsement, affiliation, or that could mislead or deceive consumers under the Australian Consumer Law or the Trade Marks Act 1995 (Cth).
  • You must not register domain names, social media handles, business names or trade marks that incorporate "Get Pingy" or any substantially identical or deceptively similar term.
  • Any feedback or suggestions you provide may be used by Get Pingy without restriction or compensation.
  • We actively enforce our rights and will pursue takedowns, account suspension, and legal remedies (including injunctive relief and damages) for infringement, passing off, or misleading conduct.

8b. Acceptable use — virtual numbers

PLEASE NOTE: We do not supply virtual numbers for individuals to receive one-time passwords, 2-factor authentication, and verification-type messages. Our numbers are provided solely for business SMS reply automation as described in these Terms. Any attempt to use the Service for OTP, 2FA, or verification purposes is a breach of these Terms and may result in immediate account suspension.

9. Governing law

These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
