The getpingy.com.au website is operated by Get Pingy Pty Ltd trading as Get Pingy (ABN 31 700 271 629, ACN 700 271 629), registered in Brisbane, QLD, Australia. In these Terms "we", "us" and "our" mean Get Pingy Pty Ltd.

By accessing this website you agree to these Terms. If you do not agree, do not use the website. We may amend these Terms from time to time by updating this page; the version in force is the one displayed when you access the website.

Get Pingy accounts are available only to individuals who are at least 18 years of age and legally able to enter into a binding agreement. If you are registering on behalf of a business, you must also be authorised to act on that business's behalf and to accept these Terms for it.

By creating an account you confirm that you meet these eligibility requirements. We may refuse, suspend or terminate an account where we reasonably believe these requirements are not met. This requirement applies to every sign-up method, including email/password registration and any current or future third-party sign-in providers (for example Google or Microsoft).

You may access this website for lawful, non-commercial informational purposes and, if you are a customer, to sign up for and manage your Get Pingy service. You must not use the website in a way that breaches any law, infringes any person's rights, or interferes with the website's operation or security.

You are responsible for the security of any credentials issued to you and for all activity under your account. Notify us immediately at hello@getpingy.com.au if you suspect unauthorised access.

The "Get Pingy" name, logo, trade marks, website content, software, designs and copy are owned by Get Pingy Pty Ltd. You are granted a limited, non-exclusive, revocable licence to view the website for its intended purpose. You must not copy, reproduce, scrape, resell, sublicense or create derivative works of the website or its contents without our written consent.

Customers receive a 7-day free trial of the Get Pingy plan they select when signing up. During the trial, customers have access to the features included in their selected plan.

Any SMS messages sent during the free trial are deducted from the monthly SMS allowance included with that plan.

If the customer chooses to continue after the trial, any unused SMS allowance remains available until the next monthly billing cycle. SMS allowances reset at the beginning of each new billing cycle and do not roll over unless expressly stated by Get Pingy.

The one-time $99 setup fee is only charged if the customer elects to continue their subscription after the free trial. No setup fee is charged during the trial period.

Get Pingy relies on mobile carriers, telecommunications networks, and third-party service providers to deliver its services. SMS delivery is not guaranteed and messages may occasionally be delayed, blocked, or fail to be delivered due to circumstances outside Get Pingy’s reasonable control. Automated missed-call responses are not guaranteed to operate without interruption and may be affected by network availability, carrier limitations, technical issues, outages, maintenance, or third-party services. Get Pingy assists businesses in responding to missed calls and customer enquiries but does not guarantee that use of the service will result in leads, bookings, sales, revenue, or any other particular business outcome.

The website may link to third-party sites and rely on third-party services. Get Pingy may use third-party service providers to support and deliver its services, including Stripe, Twilio, Supabase, Lovable, Make, and others. The providers used may vary depending on the services, features and infrastructure required, and these providers may process data outside Australia depending on their location, infrastructure and service region. Third-party services are provided and operated independently and are subject to their own terms, policies and service arrangements.

We aim to keep the website available at all times but do not guarantee that it will be uninterrupted, error-free or free of viruses or other harmful components. We may modify, suspend or discontinue the website (in whole or in part) at any time without notice.

To the maximum extent permitted by law, the website is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including as to accuracy, completeness, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. If any consumer guarantee applies and cannot be excluded, our liability for failure to comply is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied, to the extent permitted.

To the maximum extent permitted by law, and subject to the Australian Consumer Law and any rights or remedies that cannot lawfully be excluded or limited, Get Pingy Pty Ltd is not liable for any indirect, incidental, special or consequential loss or damage, including loss of profits, revenue, business opportunities, customers, goodwill or data, arising from or in connection with the use of, or inability to use, the Get Pingy website or services.

Where our liability cannot lawfully be excluded but may be limited, our liability will be limited to the maximum extent permitted by law, including, where applicable, re-supplying the relevant services or paying the reasonable cost of having those services supplied again.

If You suffer loss or damage as a result of, Get Pingy's negligence or failure to comply with these Terms, any claim by You against Get Pingy arising from Get Pingy's negligence or failure will be limited in respect of any one incident, or series of connected incidents, to the Usage Fees paid by You, to the maximum extent permitted by law.

These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
