SMS & Electronic Communications Policy
This policy explains how Get Pingy Pty Ltd sends SMS on your behalf and the rules customers must follow. It supplements the Customer Service Agreement and the Acceptable Use Policy.
1. Types of messages
- Service messages — automated missed-call replies sent to callers of your business.
- Account notifications — operational messages we may send to you (billing, trial, service updates).
- Marketing messages — commercial messages sent only where the recipient has consented.
2. Consent
You must not use Get Pingy to send unsolicited marketing SMS. Every commercial electronic message must be sent with valid consent (express or inferred) as defined under the Spam Act 2003 (Cth). Get Pingy's missed-call reply feature is typically sent in reliance on inferred consent from the recipient who initiated contact with your business; you are responsible for ensuring that reliance is lawful for each recipient.
3. Sender identification
Every commercial electronic message sent through Get Pingy must clearly identify the sender and provide sufficient information for the recipient to contact you.
4. Unsubscribe
Every automated commercial message must include a functional unsubscribe mechanism (typically "Reply STOP"). Get Pingy processes inbound STOP replies automatically and adds the sender to a do-not-message list for your account. You must not attempt to circumvent this mechanism, and you must action any manual unsubscribe request within the legally required period (5 business days).
5. Customer responsibilities
- Maintain evidence of consent for each recipient.
- Keep an accurate suppression list; do not re-add unsubscribed numbers.
- Ensure content is truthful, non-misleading and compliant with the Australian Consumer Law.
- Do not send content prohibited by carriers (see below).
6. Prohibited content
You must not send messages that contain or promote: unlawful discrimination; harassment or threats; scams, phishing or fraud; unauthorised financial or investment advice; adult, gambling or illegal-drug content; misleading or deceptive claims; malware links; or content otherwise prohibited by Australian carriers.
7. Message timing
You are responsible for the timing of any manually-triggered messages. Marketing messages should be sent within reasonable hours in the recipient's timezone.
8. Carrier limitations
SMS delivery depends on carrier networks and may be delayed, filtered or blocked by carriers or handset settings. Get Pingy does not guarantee delivery of any specific message. Some destinations may attract carrier surcharges.
9. Complaints
Recipients can report concerns to us at hello@getpingy.com.au or to the Australian Communications and Media Authority (ACMA) at acma.gov.au. See also our Opt-out page.
10. Enforcement
We may suspend outbound sending or terminate the account of any customer who breaches this policy, without limiting our other rights.
